Development is widely defined and includes: making changes to a building, erecting a new building, occupying or changing the use of land or premises, subdividing land, erecting advertising signage, demolishing a building and, generally, 'the carrying out of work'.
Council has streamlined the approval process for certain types of (minor) development by introducing two new categories - Complying Development and Exempt Development.
Complying Development I Exempt Development I Major Development I Integrated Development I
Complying Development is routine, low impact or ‘straightforward’ development that complies with the relevant Council planning controls. Complying Development requires Council approval and can only be carried out once a Complying Development Certificate has been issued. Examples of this type of development include carports and garages.
Before you start to build you must read Council's Development Control Plan (DCP) No. 57 - Exempt Development & Complying Development. You can obtain a copy from Council's Customer Service Centre, 2 Bryant Street, Rockdale. If your development does not meet the Complying Development standards in the plan, a Development Application is required.
Exempt Development is minor development that does not require consent. Examples include pergolas, cubby houses, small outbuildings and proposals to change the use of buildings in business or light industrial zones.
Although you can carry out exempt development without lodging a formal application (that is, a DA) with Council, you must firstly make sure your proposal meets the required specifications.

Major Development includes new commercial and industrial buildings and high rise buildings. Depending on the size and scope of the development, additional information will need to be lodged with your DA, including a model, specifications of materials, urban design analysis, a traffic and parking report, shadow diagrams and wind effects report. Additional sets of drawings are also required.
Council suggests you make an appointment to discuss your proposal with an Officer from the Major Development Team (9562 1677) before you lodge your DA.
Integrated Development requires the approval of another authority as well as Council, such as the Heritage Council or the Roads and Traffic Authority. |
