Voluntary Planning Agreement Details

Voluntary Planning Agreement for 8-10 Martin Avenue, 9 Bidjigal Road and 47-49 Bonar Street, Arncliffe

Council has entered into a Voluntary Planning Agreement (VPA) under section 93F of the Environmental Planning and Assessment Act in connection with an amendment to Rockdale Local Environmental Plan 2011 that applies to the land at 8-10 Martin Avenue, 9 Bidjigal Road and 47-49 Bonar Street, Arncliffe.

Description of the agreement:
In March 2014, Mecone Pty Ltd on behalf of Canberra Estates Consortium No. 42 Pty Ltd (the developer) made an offer to Rockdale City Council to enter into a VPA in connection with a proposed amendment to Rockdale Local Environmental Plan 2011.

Under the VPA the developer is required to provide $7.7 million of public benefit that includes the part dedication of 47-49 Bonar Street, Arncliffe and the embellishment of the Bonar Street Community Park Stage 2 and a playground to be constructed in Bonar Street Community Park Stage 1. The agreement also exempt the development from S94 and S94A development contributions.

Dates of notification of the proposed agreement:
The proposed planning agreement, along with the proposed planning proposal, was placed on public exhibition on two separate occasions. The first exhibition period was between Thursday 27 August 2015 for a period of 28 days, while the second exhibition period was from Thursday 26 November 2015 to Wednesday 13 January 2016 for a period of 50 days (additional days due to the holiday period).

Date the agreement was entered into:
The agreement was came into effect on 10 June 2016 following the adoption of the Rockdale Local Environmental Plan 2011 (Amendment No 12).

Canberra Estates Consortium No.42 Pty Ltd

Land to which the agreement applies:
The agreement applies to land known as 8-10 Martin Avenue, 9 Bidjigal Road and 47-49 Bonar Street, Arncliffe, as described in Schedule 2 to the agreement.

Voluntary Planning Agreement for 152-206 Rocky Point Road, Kogarah (former Darrell Lea site)

Council has entered into a Voluntary Planning Agreement (VPA) under section 93F of the Environmental Planning and Assessment Act in connection with an amendment to Rockdale Local Environmental Plan 2011 that applies to the land at 152-206 Rocky Point Road, Kogarah.

Description of the agreement:
In January 2015 Land & Portfolio Pty Ltd (the developer) made an offer to Rockdale City Council to enter into a VPA in connection with a proposed amendment to Rockdale Local Environmental Plan 2011.

Under the VPA the developer is required to provide $5.5 million of public benefit including, Local Area Traffic Management, upgrades to sporting fields, upgrades to Scarborough Park and surrounds, new playground, upgrades to Production Lane, and a child care centre.

Dates of notification of the proposed agreement:
This proposed planning agreement was publicly notified from 10 September to 9 October 2015.

Date the agreement was entered into:
The agreement was came into effect on 9 May 2016 following the adoption of the Rockdale Local Environmental Plan 2011 (Amendment No 11) came into effect.

Parties to the agreement:
Rockdale City Council
and
Land and Portfolio Pty Ltd and D. L. N. Pty Limited

Land to which the agreement applies:
The agreement applies to land known as 152-206 Rocky Point Road, Kogarah, as described in Schedule 1 to the agreement.

Voluntary Planning Agreement for 45 Bonar Street, Arncliffe

Council has entered into a Voluntary Planning Agreement (VPA) under section 93F of the Environmental Planning and Assessment Act in connection with an amendment to Rockdale Local Environmental Plan 2000 that applies to the land at 45 Bonar Street, Arncliffe.

Description of the agreement:
In March 2009 Pheonix Corporation Pty Ltd, Marke Corp Pty Ltd, Jab Developments Pty Ltd and Loucas Holdings (Arncliffe) Pty Ltd (the developer) made an offer to Rockdale City Council to enter into a VPA in connection with a proposed amendment to Rockdale Local Environmental Plan 2000.

Under the VPA the developer is required to dedicate land for the first stage of the proposed Bonar Street Community Park at no cost to Council and to design and construct the first stage of the park and widen Bonar Street adjacent to the park. The developer is also required to pay monetary section 94 development contributions towards the provision of other public amenities and services within the City.

Dates of notification of the proposed agreement:
This proposed planning agreement was publicly notified from 24 September until 23 October 2009.

Date the agreement was entered into:
The agreement was entered into on 21 December 2009 and came into effect on 28 May 2010 when Rockdale Local Environmental Plan 2000 (Amendment No 48) came into effect.

The agreement applies to land known as 45 Bonar Street, Arncliffe, as described in Schedule 2 to the agreement.

Voluntary Planning Agreement for Cooks Cove Development

Council proposes to enter into a Voluntary Planning Agreement (VPA) under section 93F of the Environmental Planning and Assessment Act in connection with a development application for the Cooks Cove site.

Description of the proposed agreement:
Boyd Cook Cove Pty Ltd (the developer) made an offer to Rockdale City Council in December 2006 to enter into a VPA in connection with the development of the land at Cooks Cove under Development Application DA-2009/112 to which Sydney Regional Environmental Plan No 33—Cooks Cove applies.

Under the proposed VPA the developer will be required to pay monetary contributions and provide other material public benefits to be used for or applied towards a public purpose, as described in the proposed agreement.

Dates of notification of the proposed agreement:
This proposed planning agreement was publicly notified from 15 January 2009 until 16 February 2009.

Date the agreement was entered into:
The proposed agreement has not yet been entered into.

Rockdale City Council,
Boyd Cook Cove Pty Ltd (the developer)
and
Cooks Cove Development Corporation

Land to which the proposed agreement applies:
The proposed agreement applies to land within the Cooks Cove Site, as described in Part B of Schedule 2 to the agreement.
